Fees for the Agenda of Board Meetings?

Today I received an email from a unit owner who says that her board and management company are not giving enough notice about upcoming board meetings. State law says that they must give 10 days notice. State law also requires that an agenda of the meeting be provided with the notice. According to this lady, no agenda is being provided but they will sell the agenda for a nominal fee 72 hours before the meeting!

This is an example of some of the stupid things that boards and management companies often do. There is no excuse for ignorance of state law on this subject, as it is one of the basic things that a board or management company must do.

She also complains of the board meeting being clear across the Las Vegas valley away from the community. Sounds to me that someone is trying to discourage attendance.

This reminds me of how Laury Phelps, a community manager, once scheduled a board meeting of my association. It was scheduled the evening before Thanksgiving. I suspect that this was not merely a stupid mistake but careful planning on her part. She wanted to minimize attendance.

With regards to sending out a meeting notice the law also provides that if the agenda is not sent out with the notice that notice of where you may obtain the agenda before the meeting be listed on the meeting notice. In my experience not too many owners ask the for agenda ahead of time. Of course if they do I just email it to them and don't even charge them for it. The idea of "selling an agenda" for a nominal fee is ridiculous.

On most occasions I am able to schedule the meeting somewhat close to the community. However there are some occasions that I have to schedule the meeting further than I wanted to. This only happens occasionally. The problem I face is that owners in most of my associations that I manage just don't come to the meetings. I guess they are either happy about what is going on in their community or just don't want to take the time to know what is going on.
